He has successfully represented both plaintiffs and defendants, including patent owners and accused infringers, in litigation around the country. For example, Mr. McDavit represented patentee-plaintiff Intellectual Ventures in a patent infringement action relating to semiconductors and electronic communications. He helped secure an infringement verdict at a jury trial in federal district court, leading to a favorable resolution of the matter.
He has also represented accused infringer-defendant Cisco Systems in several multi-patent cases concerning communications equipment and infrastructure, including managing and coordinating motion practice, claim construction, and all discovery. Mr. McDavit also has substantial experience in areas outside patent litigation, including securing a temporary restraining order for client IGT to prevent a major disruption of a recent, important trade show.
Mr. McDavit has substantial experience litigating cases in jurisdictions throughout the country, including the Eastern District of Texas, the District of Delaware, the District of Massachusetts, the District of Nevada, the District for the District of Columbia, and the Northern District of California. He is a former U.S. Navy submariner, who held the rank of Lieutenant Commander, and a graduate of the Georgetown University Law Center and the University of Notre Dame. Prior to joining Desmarais LLP, Mr. McDavit practiced in the Intellectual Property group of Kirkland & Ellis LLP.
