Alan Kellman's practice focuses on the trial of patent infringement disputes. Mr. Kellman has tried cases in the federal district courts, before the International Trade Commission, and in arbitration, and has argued before the Court of Appeals for the Federal Circuit.  In addition, he has represented clients in trade secret, antitrust, and unfair competition matters in federal and state courts.  Mr. Kellman has represented and counseled clients in disputes relating to a wide range of technical subject matters, including pharmaceutical and surgical products, network switching equipment, telecommunications equipment, local and wide area networks, digital signal processing systems, digital audio and video coding systems, cellular telephony, personal computers, digital watermarking, semiconductor processing technology, microprocessor design and development, electro-chemical lighting systems, lottery networking systems, and remote surgical robotics.

Before joining Desmarais LLP, Mr. Kellman was a partner in the Intellectual Property group of Kirkland & Ellis LLP.

  • Represented Intellectual Ventures against Canon, Nikon, and Olympus in patent infringement litigations involving digital camera technology and image sensor design.
  • Represented LifeCell Corporation against TELA Bio, Inc. in a trade secret and unfair competition case involving surgical mesh products.
  • Represented Nokia Corporation against HTC in a patent infringement dispute before the International Trade Commission concerning smartphone and transceiver technology.
  • Represented GlaxoSmithKline against Genentech Corp. in a patent infringement litigation involving the monoclonal antibody products Herceptin and Lucentis.
  • Represented Walker Digital against the Multi-State Lottery Association in a patent infringement litigation concerning lottery systems.
  • Represented Oasis Research in several patent litigations involving online backup and software-as-a-service technology.
  • Represented GlaxoSmithKline against Apotex, Inc. in a patent and antitrust litigation involving the prescription antidepressant Paxil.
  • Represented IBM against Fifth Generation Computer Corp. in a patent infringement litigation involving supercomputing and parallel processing technology.
  • Represented Alcatel-Lucent against Dell Computer in a patent infringement litigation involving web-based systems.
  • Represented Alcatel-Lucent against Microsoft Corp., Dell Inc., and Gateway, Inc. in a multi-patent litigation involving perceptual audio coding, digital video compression, user interface, and communications protocol technologies.
