Desmarais LLP Defeats Transfer Request in Texas Patent Case

News

Desmarais LLP won a key ruling in a patent infringement case representing Monterey Research that blocked the lawsuit’s transfer out of Waco Federal Court in the Western District of Texas.
 
In a 38-page ruling on February 21, 2022, Judge Alan Albright denied the defendant Broadcom’s motion to transfer the case to the Northern District of California. The lawsuit, filed in May 2021, relates to semiconductors and integrated circuits. In the ruling, Judge Albright wrote that after weighing the private and public interest factors under the “clearly more convenient” standard, the case did not merit a venue change.
 
“The Court concludes Broadcom has not met its requisite burden to dictate transfer to the [Northern District of California],” Judge Albright wrote.
