Tamir Packin Recognized as a 2023 New York Law Journal Rising Star

Accolades

The New York Law Journal highlighted Desmarais LLP partner Tamir Packin as a 2023 Rising Star for his role in twice defeating patent infringement claims against his client Cisco at trials in federal court in Boston.

The Massachusetts-based software company Egenera pursued nearly $400 million in damages based on infringement claims related to the same virtual networking patent (No. 7,231,430). In 2019, during a three-day bench trial, as lead counsel, Packin secured a win for Cisco by persuading the judge to invalidate the patent because Egenera improperly removed one of its original inventors. In 2022, during a two-week jury trial, Packin, who was co-lead trial counsel with firm founding partner John Desmarais, won a complete defense verdict after fully demonstrating that Cisco had not infringed the patent.

Packin told The New York Law Journal that his best advice for young lawyers going to trial is: “It’s tempting to pursue as many arguments as possible at trial, but remember your credibility is on the line and juries can only absorb so much. To win, you must cut peripheral arguments in favor of aggressively pursuing your primary argument.”
