Jonas McDavit is a partner at Desmarais LLP.  He has extensive experience representing clients in high-stakes patent infringement cases before the Federal Circuit Court of Appeals, several federal district courts, the International Trade Commission, and the USPTO Patent Trial and Appeal Board. He handles cases involving diverse areas of technology, including computer hardware and software, semiconductors, wireless communication, mobile devices, image sensors, gaming, pharmaceuticals, photo-imaging equipment, and consumer products.
 
He has successfully represented both patent owners and accused infringers in litigation around the country. For example, Mr. McDavit represented patentee-plaintiff Intellectual Ventures in a patent infringement action relating to semiconductors and electronic communications. He helped secure an infringement verdict at a jury trial in federal district court, leading to a favorable resolution of the matter. 
 
He has also represented accused infringer-defendant Cisco Systems in several multi-patent cases concerning communications equipment and infrastructure, including managing and coordinating motion practice, claim construction, and all discovery. Mr. McDavit also has substantial experience in areas outside patent litigation, including securing a temporary restraining order for client IGT to prevent a major disruption of a trade show.
 
Mr. McDavit has substantial experience litigating cases in jurisdictions throughout the country, including before the Federal Circuit Court of Appeals, the Patent Trial and Appeal Board, the International Trade Commission, and before several United States District Courts such as the Eastern District of Texas, the Western District of Texas, the District of Delaware, the District of Massachusetts, the District of Nevada, the District for the District of Columbia, and the Northern District of California. 
 
Mr. McDavit has been invited to speak at several patent law related events, including at the 2018 and 2019 Litigation Finance Dealmakers Forums.  He is a member of the New York State Bar Association and has been admitted to practice throughout the country.
 
Prior to joining Desmarais LLP, Mr. McDavit practiced in the Intellectual Property group of Kirkland & Ellis LLP.  Mr. McDavit is a former U.S. Navy submariner, who achieved the rank of Lieutenant Commander.  He is a graduate of the Georgetown University Law Center and the University of Notre Dame.

  • Represented Monterey Research against multiple defendants in multiple jurisdictions, including arguments before the Patent Trial and Appeals Board.  The cases involved semiconductor design and technology.
  • Represented Papst Licensing against multiple defendants in a case involving transferring digital files.  The case included including live hearings on claim construction and dispositive motion practice.
  • Represented Cisco Systems against Egenera Inc. in a patent infringement litigation that included, significant dispositive motions, an inventorship trial, and an infringement trial.
  • Represented Nokia in multiple patent infringement actions, including a patent assertion before the International Trade Commission and a defense of Nokia in the District of Delaware.
