Eli Balsam’s practice focuses on intellectual property and technology-related litigation, including patent, copyright, trademark, and unfair competition litigation for both plaintiffs and defendants. Mr. Balsam has experience with pre-suit diligence, pleadings, claim construction, discovery, infringement and invalidity contentions, taking and defending fact and expert depositions, dispositive motion practice, hearings, licensing issues, and Federal Circuit appeals in cases involving wearables, web technology, secure processing, encryption, semiconductors, integrated circuits, and mechanical magazine loaders. Mr. Balsam also assists the firm’s post-grant group with Patent Trial and Appeal Board ("PTAB") proceedings and has prepared amicus curiae briefs on cutting-edge intellectual property issues in both the U.S. Supreme Court and the Federal Circuit.

Before joining Desmarais LLP, Mr. Balsam served as a law clerk to the Hon. Ralph K. Winter on the U.S. Court of Appeals for the Second Circuit. During law school, Mr. Balsam litigated First Amendment cases at the Becket Fund for Religious Liberty, assisted in the preparation of an amicus brief in the U.S. Supreme Court with the American College of Trust & Estate Counsel, and represented prisoners in disciplinary and parole proceedings at the Prison Legal Assistance Project. Mr. Balsam was also an Article Editor on the Harvard Environmental Law Review and a Team Captain and Oralist in the Ames Moot Court Competition.
